Terms and Conditions for AI Chefs, LLC

BY CREATING AN ACCOUNT ON OUR PLATFORM, YOU ARE AGREEING TO THESE TERMS, OTHER METHODS OF ACCEPTANCE INCLUDE: EXECUTING A SALES ORDER OR OTHER DOCUMENT THAT REFERENCES THESE CONSUMER TERMS, OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE. YOUR USE OF THE SERVICE, AND AMBITIOUS LABS PROVISION OF THE SERVICE TO YOU, CONSTITUTES AN AGREEMENT BY AI CHEFS AND BY YOU TO BE BOUND BY THESE TERMS.

1. Acknowledgement

This Agreement is between AI Chefs, LLC ("AI Chefs") and the End-User only, not with Apple. AI Chefs, not Apple, is solely responsible for the Kasper app and its content. The usage rules for the Kasper app, provided by AI Chefs, will not conflict with the Apple Media Services Terms and Conditions.

2. Scope of License

The license granted to the End-User for the Kasper app is limited to a non-transferable license to use the app on Apple-branded products owned or controlled by the End-User, in accordance with Apple's Usage Rules. The app may also be accessed by other accounts associated with the purchaser via Family Sharing or volume purchasing.

3. Maintenance and Support

AI Chefs is solely responsible for providing maintenance and support for the Kasper app as required by law. The End-User acknowledges that Apple has no obligation to provide maintenance or support for the app.

4. Warranty

AI Chefs is responsible for any warranties related to the app, to the extent that such warranties cannot be disclaimed. If the app fails to conform to any applicable warranty, the End-User may notify Apple for a refund of the purchase price; however, Apple will have no further warranty obligations.

5. Product Claims

AI Chefs, not Apple, is responsible for addressing any claims by the End-User or third parties concerning the Kasper app or the End-User's use of the app. This includes product liability claims, compliance with legal and regulatory requirements, and consumer protection or privacy claims.

6. Intellectual Property Rights

In case of any third-party claim that the Kasper app infringes intellectual property rights, AI Chefs will be solely responsible for the investigation, defense, settlement, and discharge of the claim.

7. Legal Compliance

The End-User represents that they are not in a country under a U.S. Government embargo or designated as a "terrorist supporting" country, and they are not on any U.S. Government list of prohibited or restricted parties.

9. Third Party Terms of Agreement

The End-User must comply with third-party terms of agreement when using the Kasper app, ensuring they are not violating their wireless data service agreement.

10. Third Party Beneficiary

The End-User acknowledges that Apple and its subsidiaries are third-party beneficiaries of this Agreement and that Apple has the right to enforce this Agreement against the End-User.
